This Website is provided by the Healthcare Association of New York State, Inc., and/or one its subsidiaries or affiliates (collectively referred to as “Organization ,” “we,” “our” or “us”).  This Privacy Policy (“Policy”) describes how we collect, process, retain, and disclose business and personal data when you visit or interact with one of our websites that link to this Policy, including but not limited to hanys.org, https://datagen.info/, and hanysmarketplace.com (collectively “Website(s)”), and our practices for using, maintaining, protecting, and disclosing that information.

This Policy applies only to information we collect:

  • Through the Websites.
  • In communications, including email, text, chat, and other electronic messages, between you and the Websites.

It does not apply to information collected by:

  • Us offline or through any other means, including on any other website operated by Organization or any third-party (including our affiliates and subsidiaries) that does not link to this Policy;
  • Any third party, including through any application or content that may link to or be accessible from or through the Website; or
  • Us when providing our Contracted Services (defined below). Our Organization is often a business-to-business service provider for contracted for products or services (collectively, “Contracted Services”). In the course of providing our Contracted Services to our business customers, we may receive personal information or protected health information about individuals directly from the organization with which they are affiliated, such as their employer or health care provider. This information is provided to us so that we can deliver, maintain, and support the Contracted Services our customers have requested. When we receive this information from our customers, we may act as a “service provider” (as defined under applicable data protection laws). We process that information solely pursuant to the customer’s instructions and our contractual obligations. This includes the Contracted Services provided by DataGen.

We may provide additional or different privacy policies that are specific to certain features, services, activities, or subsidiaries or affiliates.

By using the Websites, you accept and agree to be bound and abide by our Privacy Policy and Terms of Use, incorporated herein by reference. If you do not want to agree to the Terms of Use or the Privacy Policy, you must not access or use the Websites.

The Websites are not intended for use by children under eighteen (18) years of age. Organization does not knowingly or intentionally solicit or collect Personal Data from or about any such children or market its products or services to children. If Organization becomes aware that it has inadvertently received Personal Data from a user under the age of eighteen (18), it will delete such Personal Data from its records.

INFORMATION WE COLLECT AND PROCESS AND HOW WE COLLECT IT

We collect different types of information from and about users of our Websites. Through the use of our Websites, the information we collect may include, but not be limited to:

  • Personal Data: We may collect data about you by which you may be personally identifiable such as name, telephone number, email address, mailing address, job title, username and password, or other similar information that can be used to identify you (“Personal Data”).
  • Usage Data: Data may be collected from you automatically when you access our Websites about how you access and use our Websites (“Usage Data”). Usage Data may include information such as your device’s Internet Protocol (IP) address, internet domain, browser type, browser version, internet service provider (ISP) the pages of our Website that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data, the files viewed on our Website (e.g., HTML pages, graphics, etc.), and your operating system.
  • Location Information: We may also collect location information, which allows us to provide geofencing features and other technical services that depend on location based data. This information may be derived from your device’s settings, IP address, or other technical signals, depending on how you interact with our Website and your device permissions. We do not collect precise geolocation information, but approximate location based on your country or city.
  • Aggregate Data: We may collect data that is about you but does not individually identify you, such as statistical information and analytic data relating to Website usage. For more information, please see the “How We Use Your Personal Data” section below.

We collect your information in the following ways:

  1. Information you provide to Organization. When you interact with our Website or any sites or services that link to this Privacy Policy, we may collect Personal Data and other information from you. We collect Personal Data from you when you submit web forms or interact with our Website; for example, by subscribing to a blog, signing up for a webinar, subscribing to one of our services or requesting customer support. We may ask for your email address, first and last name, job title and other similar business information.
  2.  Organization event registration. When you register for an event, we collect information such as name, address, phone number and email address. We use this information to communicate with you and in some cases facilitate your registration. Additionally, we may share your registration data with event service providers in order to provide event information and improve your experience at the event or future events.
  3. Account and user information. We collect Personal Data when you sign up for an account, create or modify user information, set preferences or provide any other related information to access or use our services. 
  4. Payment information. We use secure third-party payment service providers to manage payment processing, which is collected through a secure payment process. We do not store payment card information, and only store such information as necessary to process your transaction.
  5. Via automatic Website technologies. As outlined above, we may automatically collect Usage Data as you utilize our websites. For more information, see our “Cookies and Similar Technologies” Section below.
  6. Personal Data from different sources. We may collect Personal Data about you from other sources, such as third-party providers,  publicly available sources (like social media platforms), and from other companies and our subsidiaries and affiliates. This may include physical mail addresses, job titles, email addresses, phone numbers, IP addresses and social media profiles. This helps us to update and improve our products, services and records, identify new customers, create more personalized advertising, suggest products and services that may interest you, deliver personalized communications and promote events. 

HOW WE USE PERSONAL DATA

  1. To communicate with you about the products and services. We use the information you provide when signing up for our products and Services to send you transactional emails or account management and other administrative matters.
  2. To provide our Websites. We use your information to provide our Websites and to provide any content, features, information, or other services available through the Websites.
  3. To provide products and Services. We use your account information to provide products and services to you. We also use this information to authenticate you when you log in and to provide customer support.
  4. To improve products and services. We use the information you provide us, professional data, log files and usage data about how you or your users interact with our products and services to develop and improve our products, services and communications.
  5. To aggregate data. We may publish data about how our products and services are being used across our customer base. When we share statistical information externally in this way, the data will be aggregated and we will not identify individual users or customers.
  6. For Security. We use your information for information technology security and, to the extent applicable, to investigate and help prevent security incidents. We may also use this information to meet legal requirements. We use your information to verify user accounts and detect and prevent product abuse or fraud.
  7. To market and promote products and services. We use Personal Data to advertise, market and promote our products, services and other offerings. For example, we may send you marketing communication relating to our product and services. You may opt out of receiving promotional content by following the instructions contained in each communication that we send to you. If you unsubscribe from our marketing lists, we will continue to contact you regarding administrative matters and respond to your requests.
  8. To tailor and improve your experience. We may use information collected from other sources in combination with information we collect for the purpose of providing you with updates and improved services, personalized communications, event promotion and to otherwise improve the user experience. 
  9. Other purposes if we obtain your consent. We may use your Personal Data for other purposes when you give us consent to do so.
  10. Legal process or to enforce or policies and contracts. We may use your Personal Data to comply with any court order, law or legal process, including responding to any government or regulatory request. We may also use your Personal Data to enforce our rights arising from any contracts, including for billing and collections, or to enforce our policies.

HOW WE SHARE OR DISCLOSE PERSONAL DATA

  1. Product support and marketing. We may share Personal Data with our third-party service providers to support our Websites, products and services. We may also share with trusted third parties to provide you with co-marketing content that we think may be relevant to you, to provide advertisements to you, or for our other marketing purposes.
  2. Organization Marketplace. When you use the Organization Marketplace, we may share your Personal Data with our marketplace partners who may contact you to provide promotional materials on their offerings. We will only share your Personal Data with our marketplace partners when you visit and interact with their listing page or as otherwise requested or directed by you.
  3. Organization changes. If we (or our assets) are acquired by another Organization, whether by merger, acquisition, bankruptcy or otherwise, that Organization would receive all information gathered by us on our Website, products and services. In this event, you will be notified via email and/or a prominent notice on our Website of any change in ownership and choices you may have regarding your Personal Data.
  4. Forums. Some of our  Websites offer message boards, blogs and community forums. Please keep in mind that if you directly disclose any information through our public message boards, blogs or forums (including profile information associated with the account you use to post the information) it may be read, collected and used by any member of the public who accesses these Websites. Your posts and certain profile information may remain even after you terminate your account. You are solely responsible for any information uploaded or entered. You should exercise caution when deciding to disclose your Personal Data in such submissions or posts. We cannot prevent others from using that information in a manner that may violate this Policy or the law. We are not responsible or liable for any issues that may arise with respect to information provided by you or the results of such posting. You shall not provide any information other than your own or of others without their express consent. You understand and agree that we may not review, audit, or otherwise verify the accuracy of your or other individuals data provided via these mechanisms.
  5. Compelled disclosure. We reserve the right to use or disclose your Personal Data if required by law or if we reasonably believe that use or disclosure is necessary to protect our rights, protect your safety or the rights and safety of others, investigate fraud or comply with a law, court order or legal process.

We do not sell Personal Data. We may disclose aggregated information and information that does not identify any individual without restriction.

HOW WE STORE AND SECURE PERSONAL DATA

  1. Data storage and security.  We have implemented measures designed to secure your information from accidental loss and from unauthorized access, use, alteration, and disclosure. However, the safety and security of your information also depends on you.  Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Data, we cannot guarantee the security of your Personal Data. Any transmission of Personal Data is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.
  2. Retention of Personal Data. How long we keep information we collect about you depends on the type of information and how we collect and store it. We retain Personal Data that you provide to us where we have an ongoing legitimate business need to do so (for example, as needed to comply with our legal and compliance obligations, resolve disputes and enforce our agreements). When we have no ongoing legitimate business need to process your Personal Data, we securely delete the information or anonymize it or, if this is not possible, securely store your Personal Data and isolate it from any further processing until deletion is possible.

COOKIES AND SIMILAR TECHNOLOGIES

We use cookies, pixels, analytics tools and other technologies for several reasons. Some cookies and other technologies are required for technical reasons for our Website to operate properly; others enable us to perform analytics, provide different functionality or engage in targeted advertising.

We may automatically collect, use, store, and transfer certain information about your visit to our Website through such technologies. These Tracking Technologies may be provided by third parties that help us with: (a) analytics and measurement (for example, Google Analytics); (b) advertising and conversion tracking (for example, Google Ads and the LinkedIn Tag); (c) marketing automation and customer relationship management (for example, HubSpot); (d) user experience and site optimization tools (for example, Hotjar); (e) embedded media players (for example, YouTube embeds); and (f) social media features and widgets (for example, X (formerly Twitter) and Facebook widgets). Depending on the Tracking Technology and your device/browser settings, the information collected may include Personal data or other information, including, but not limited to, identifiers and device information (such as cookie IDs, device identifiers, IP address, and browser type), approximate location (such as city, state, or country), information about your interactions with our websites (such as pages viewed, links clicked, scroll activity, time spent, search queries entered on-site, and form interactions), and referral information (such as the website or advertisement that led you to our websites). Some third parties may combine information collected from our Websites with information collected from other websites or services over time, subject to their own privacy practices.

If you do not want Organization to collect information about you through the use of cookies or Tracking Technologies, you can manage certain Tracking Technologies and other cookies through our cookie consent manager (also called a cookie preference tool), which is available through the cookie banner and/or a persistent link or button on our Websites, or you have the option to delete or disable cookies on your internet browser. If you choose to delete or disable Organization’s use of cookies, then the functionality of the Website may  be impaired.

You also have the option to manage cookies using your browser. In addition to managing your cookie preferences through individual sites, you can set or amend your web browser controls to accept or refuse cookies. As the means by which you can refuse cookies through your web browser controls vary from browser to browser, you should visit your browser's help menu for more information. Some browsers offer “Do Not Track” signals and similar mechanisms, and some jurisdictions recognize opt-out preference signals such as Global Privacy Control (GPC). At this time, our Websites do not respond to or honor these signals.

THIRD-PARTY SERVICE PROVIDERS

Some of our Websites or features, functions, or services provided via the Websites are developed, hosted, and managed by third-party service providers. Some of the information collected through our Websites is not collected directly by the Organization but is collected by our service providers. By using our Websites, you understand that your Personal Data may be shared with and/or collected by our service providers.

LINKS OR REFERENCES

Our Websites may contain links or references to other websites or access to applications, including social media websites and applications, that are operated by third parties.  Please be aware that the Organization is not responsible for the privacy practices of any third party, including any third party with whom it has an affiliation or business relationship. We do not control, and we shall have no liability or responsibility whatsoever for any third-party websites, and this Privacy Policy does not apply to those websites. Please consult the terms and conditions and privacy policies of those third-party websites to find out how they collect and use your information and to determine whether and how they use cookies.

HANYS Marketplace listings and references to third-party products or services are provided for convenience and informational purposes. Marketplace partners, unless otherwise stated, are independent third parties, and the Organization does not control and is not responsible for their websites, products, services, or privacy and data practices. Your interactions with any marketplace partner, including any information you choose to provide to them, are governed by that partner’s terms and privacy policy.

We may receive some information that you submit to a third-party website or application that you access through the Website.

CHANGES TO THE PRIVACY POLICY

We may revise and update this Privacy Policy from time to time in our sole discretion. All changes are effective immediately when we post them and shall apply to all access and use of the Website thereafter.
